Effective September 1, 2015 the Access to Justice Act is amended adding a $2.00 fee at the time of filing the first pleading, paper, or other appearance filed by each party in all civil cases.
- The Filing Fees for the Kendall County Circuit Court Clerk are set forth in 705 ILCS 105/27. la and are available at the clerk’s office and on this web site.
- Fees are payable in advance in the form of cash, money order, cashiers check or personal check. We do not accept credit card payments at this time.
- Civil cases are filed only if the proper fees are remitted at the time of filing. All new cases filed should include a new case information sheet, all pertinent documents and the correct fee based upon case type and the documents sent.
- It is now mandatory to file civil cases electronically and the proper fees apply.
- All documents must be filed on 8 ½ x 11 paper. Local Rule sets out standard format & requirements for forms and documents filed with the Clerk.
- Kendall County Administrative Local Rule 87-6, effective February 20, 1987 provides an automatic 90 day status return date to be assigned by the Circuit Clerk at the time of filing on civil cases and a 9 month status return date on probate cases. All parties or their attorneys are expected to appear unless otherwise ordered by the court. If no one appears on behalf of the plaintiff on a status date, the case may be dismissed for want of prosecution or sanctions may be ordered as provided in Supreme Court Rule 219.
- Public Act 91-621, ILCS 5/5-105 directs the clerk to post a notice in English and Spanish reciting as follows: “If you are unable to pay the fees, costs, and charges of an action, you may ask the court to allow you to proceed without paying them.” You may prepare the Application for Fee Waiver, click here or ask the clerk for an Application to Sue or Defend as an Indigent Person.
- We do not accept for filing, documents such as depositions, interrogatories, answers or responses thereto and other discovery documents. This rule does not apply to requests to admit facts or to the answers or responses thereto. Proof of service, notice of filing and answering discovery documents is required to be filed.
- Do not put multiple case numbers on one original document. We must have an original document for each case number. Do not staple documents, we scan our documents.
- The statutory fee for correction of the case number, case title, or attorney registration number on any document is $25 per document. If you are unsure of a case number call for a correct number.
- Please note that we do not accept documents for filing by fax.
- Since we schedule court dates from filed documents, all original documents must be filed with our office at least 3 days prior to any scheduled court date in order to be heard. Please refer to Kendall County Administrative Order 01-01 for this rule and other applicable court rules regarding civil proceedings.
