Kendall County has a strong agricultural heritage, and has established zoning regulations to protect this resource while still permitting appropriate development. In general, one home is allowed for each 40 acres within agriculturally zoned property. However, some exceptions are provided to accommodate historical development patterns and physical site conditions which may limit the ability to farm a particular site. Section 36-281(19) of the Kendall County Code details the specific regulations governing single-family homes in the agricultural district. Locally, we refer to provisions for single family homes in agricultural areas as Ag Allocations. In general, these regulations permit:
- One home per 40 acres. Home sites must be registered with the County.
- Smaller lots in specific situations when lot existed prior to March 8th, 1977 (see Section 36-281(19) for additional details).
- Replacement homes if an existing residence is destroyed.
- Elderly Cottage Housing (ECHO Housing) to accommodate independent living quarters for elderly or disabled family members inside or within 500’ for a farm residence.

Once an allocation is registered you have the right to waive your right to the permitted building permits. You can waive your rights to one building permit or multiple building permits to the same person(s).
